about CAPS for Polish CASPs and obliged institutions

How does CAPS relate to the Article 52 training obligation in the Polish AML Act?

Article 52 of the AML Act of 1 March 2018 requires obliged institutions to have persons performing AML/CFT duties take part in training. It sets a duty to train — it doesn’t set a depth. CAPS sits at the top of our three-level pathway, above AML Foundations and CASS, and is aimed at the person whose judgement the institution relies on rather than at general staff awareness.

Why pay for advanced certification when Article 52 training is already mandatory?

Because the two answer different questions. Joint Communication No. 92 from GIIF, UKNF and the National Bank of Poland reads Article 52 broadly, covering employees, civil-law contractors, agents, entities acting for the institution, AML-responsible management-body members and those who stand in for AML staff. Meeting that duty across a headcount is a volume exercise — qualifying the person who signs off decisions is not.

Is CAPS accredited, and does KNF recognise it?

CAPS is CPD accredited and developed with practising AML specialists. KNF does not recognise, approve or endorse it, and no Polish or EU regulator formally recognises named private certifications for fit-and-proper purposes.

Who at a Polish obliged institution can enrol in CAPS?

The entry test is the same wherever you sit. • At least four years of professional experience in AML compliance or a related field. • A recognised AML certification such as CASS or an equivalent qualification, or other professional recognition. Does CAPS produce evidence a Polish management board can use for Article 52 reporting?

It produces a CPD-accredited Certified Anti-Money Laundering Principal Specialist certificate and a year of CPD institute membership, both dated and verifiable. Communication No. 92 says the management board should hold full and current information on how the training obligation is being met, reported for instance through the AMLRO.

Can I enrol without four years of AML experience?

No, and the rule is applied without exception. CAPS assumes you have already made difficult calls rather than read about them. CASS at €959 is the step immediately below and takes most people where they need to be, with AML Foundations available if you are earlier in the role. There’s no shortcut into the top level, by design.

How long does CAPS take for a working Polish AML officer?

Five to six weeks of online, self-paced study. Nothing has to be attended at a fixed hour, which matters in an institution where the reporting rhythm to GIIF isn’t negotiable and the training calendar is. You work through the material in the gaps rather than clearing a week that would get taken back anyway.

Is CAPS taught in Polish?

No, the programme is delivered in English, with the Polish context carried in the material: the AML Act of 1 March 2018, the supervisory roles of KNF and GIIF, and MiCA as it applies to crypto-asset service providers. Polish statutory terminology appears where it should, because instytucja obowiązana and AMLRO carry meanings that don’t survive a loose translation.

What is the CAPS exam like for Polish candidates?

Sixty questions online in ninety minutes, mixing multiple choice, case-based scenarios and true/false items. No test centre, no travel to Warsaw. The scenario questions dominate the difficulty and they are deliberately written around situations where the correct answer is contested, which is the situation an AML officer is paid to resolve rather than escalate.

What score do I need to pass CAPS?

At least 80% of the sixty questions. That is the programme’s own standard. Polish law sets no examination and no pass mark for AML staff, since Article 52 obliges institutions to provide training rather than to certify outcomes, so a high internal bar is what makes the certificate mean something beyond attendance.

What happens if I do not pass the CAPS exam first time?

You have two further attempts. Each opens fifteen days after your last sitting, and each costs €75. Feedback comes with every result and points at the sections that cost you marks. If your institution is tracking training completion for management-board reporting, tell whoever compiles that report about the fifteen-day intervals so the timeline is realistic from the start.

Will the CAPS certificate be recognised outside Poland?

Yes. You receive the Certified Anti-Money Laundering Principal Specialist certificate, which is recognised in Poland and abroad. Much of the syllabus rests on MiCA and the EU AML package rather than on national detail alone, so the qualification doesn’t lose its meaning if you move to a group entity in another Member State or to an international team in Warsaw.

How and when is the certificate issued?

Digitally, the moment you pass, alongside the official CAPS designation. Nothing waits on printing or delivery. That is useful when the completion date has to land inside a reporting period, since Communication No. 92 expects oversight of the training obligation to form part of periodic reviews or meetings of management bodies rather than to be reconstructed afterwards.

What does CAPS cost for a Polish institution?

The CAPS programme for Polish CASPs costs €1695 including VAT, covering course materials, the exam fee and certificate issuance. The price is set in euro rather than złoty — so if your institution budgets in PLN, allow for the conversion rate at the date of payment rather than at the date of approval. Retakes, if needed, are €75.

Is there a discount for Polish public-sector AML staff?

Yes. Public sector employees are eligible for a 20% discount on the programme fee, and other promotions run periodically, so it is worth asking what is open. Staff at UKNF or at GIIF should identify their employer when enquiring, because the standard price quoted on the page is not the one that applies to them.

Can a Polish obliged institution be invoiced for the programme?

Yes, we accept organisational sponsorships, and [email protected] handles bulk enrolments and business invoicing. One thing worth planning for: Communication No. 92 says those who stand in for staff responsible for AML/CFT tasks should also be trained appropriately, so the person who covers your absence is part of the obligation rather than outside it.
